Kenyan visa applicants: false papers can mean a 1–5 year China ban

A State Council rule in force since 15 September lets China bar any foreigner for one to five years over false visa documents, and visa agents in China must now register with police.

A foreigner, Kenyans included, who gives false documents or makes a false statement when applying for a Chinese visa can be barred from entering China for one to five years. The rule is in Article 5 of a State Council regulation that took effect on 15 September.

The ban in the regulation, State Council Order No. 841, covers visa applications made abroad and requests to enter at a port of entry. It applies to all foreign nationals. Premier Li Qiang signed it on 22 July, and the government published it on its website, gov.cn, on 31 July.

A second ban applies to foreigners who were criminally punished for border-management offences, or received an administrative penalty for obtaining entry documents by fraud or for illegal entry or exit. The immigration authority can bar them for one to five years from the day the penalty has been fully carried out. For the false-papers ban, the decision rests with the immigration authority or the visa office; for this second ban, with the immigration authority. The article adds that other laws take precedence where they provide differently.

Under Article 3, the purpose of any entry, stay or residence must be genuine and lawful, and officials can question applicants and ask for documents and electronic data. A person or organisation that issues an invitation letter or other application papers must answer for the truth of what they say, and help officials check it. False papers or statements can also lead to a visa, entry or exit being refused.

The rules on agents are in a separate document. On 14 September the National Immigration Administration and the State Administration for Market Regulation issued Announcement No. 6 of 2026, which also took effect on 15 September. It sets out how firms that handle visa, study and work paperwork for a fee must register.

Article 2 of the announcement defines the service: advising on exit-entry policy, handling documents and completing procedures for people travelling for tourism, business, study, work or settlement, in return for a fee. Article 3 requires each agency to file with the exit-entry office of the public security bureau at county level or above where it is based. A branch in another area files separately. The agency's legal representative or head, its managers and the staff who deal directly with clients are filed through the agency.

Article 5 lists what the filing must contain: an agency information form, personnel forms with proof of identity and employment, a declaration of no relevant criminal record from the legal representative and from staff who serve clients directly, proof of premises and a description of internal management systems. An agency that arranges travel out of China must also submit cooperation agreements or letters of intent with service providers abroad.

The State Council regulation sets the timing. Under Article 7, a new agency must file within 15 days of being set up. An agency that was already in business before 15 September has 90 days from that date. Article 8 adds that the legal representative must have no record of a criminal penalty for an intentional crime, and that foreign firms and institutions may not offer exit-entry agency services inside China.

Article 12 of the announcement requires agencies to keep a service ledger and client files recording who the client is, what was asked for and the result, and to store contracts, personal data and financial vouchers. Article 10 of the regulation bars an agency from supplying or helping to supply false materials, or helping others obtain visas or residence documents improperly. Article 13 of the announcement says violations are punished under Articles 12 and 13 of the regulation, and criminal liability applies where an offence is committed.

The National Immigration Administration will set up a nationwide public platform on its website listing registered agencies and staff, Xinhua Finance reported on 15 September.

Kenya is not among the 57 countries on the National Immigration Administration's list for 240-hour visa-free transit, on a page dated 20 August. The page says work, study and press activities still need a visa arranged in advance.
